Now, there\u2019s another battle brewing following recent land use changes that would allow for housing on another portion of the Newport Beach Golf Course.<\/p>\n<p>In April, the California Coastal Commission approved the land use amendment that would allow housing to be built on the southern parcel of the property \u2014 along with other areas within the city \u2014 to help add nearly 4,845 units to Newport Beach\u2019s housing inventory.<\/p>\n<p>While there are no specific proposals yet, the parcel cleared for housing is where holes 3 through 8 are played.<\/p>\n<p>Don Schmitz, president of Schmitz &amp; Associates and a land-use consultant for Newport Beach, gave a presentation to the Coastal Commission at its most recent April meeting, speaking about the state\u2019s mandate that Newport Beach have the zoning in place that would allow developers to build at least 4,845 new housing units this decade to help meet future needs in the state. (Photo by Paul Bersebach, Orange County Register\/SCNG)\n<\/div><span>Expand<\/span><\/div><\/div>\n<p>\u201cIt is the most inappropriate location for housing,\u201d\u00a0 he said. \u201cThere is no need to destroy our golf course for housing.\u201d<\/p>\n<p>Heather Cieslak, Newport Bay Conservancy operations director, is also \u201cdeeply concerned\u201d about impacts on the Upper Newport Bay Nature Reserve and other sensitive areas in the area if housing is developed, she said.<\/p>\n<p>There could be significant habitat degradation and water quality impacts, she argued.<\/p> <div>\n<\/div>\n<p>\u201cWe believe this proposal does not demonstrate consistency with the Coastal Act, specifically with protecting environmentally sensitive habitats and water quality,\u201d she said.<\/p>\n<p>Coastal Commission Executive Director Kate Huckelbridge acknowledged the land is near \u201cone of the most ecologically valuable and sensitive areas in our region.\u201d But the commission must also consider and balance the need for housing, she said.<\/p>\n<p>The county-owned portion of the golf course with nine holes would remain, Huckelbridge added.<\/p>\n<p>\u201cAt the end of the day, there\u2019s nothing we as a commission can do or say that would keep that golf course a golf course,\u201d noted Commissioner Ray Jackson. \u201cIt is a privately owned golf course. I understand it is for public recreation. But that public recreation could be 50 pickleball courts. It\u2019s irrelevant, as far as we are concerned.\u201d<\/p>\n<p>Commissioner Vivian Moreno added,\u00a0\u201cWe have to find innovative ways to meet the state\u2019s mandates.\u201d<\/p>\n<p>The 55-year leases for two of the three parcels that make up the golf course are up.<\/p><p>Read more <a href=\"https:\/\/siliconvalleymovingpost.com\/?p=1535\">Corona del Mar, University, Woodbridge earn high seeds for CIF-SS boys tennis playoffs<\/a><\/p>\n<p>The third part, where holes 10 through 18 sit on 32.5 acres of property, is owned by the county and is leased to the Newport Beach Golf Course, according to Orange County CEO spokesperson Daniel Rhodes.<\/p>\n<p>That lease is in month-to-month holdover status, he said, though the county has no plans for alternate uses of the property and would assess proposals for the property at such time as the lease ends and or the golf operations cease.<\/p>\n<p>Golf advocates are still fighting plans for a surf park proposed for the middle section of the course.<\/p>\n<p>In October, plans for the Snug Harbor Surf Park, along with a 50-foot-tall building for a surf academy, shop and restaurant, were given approvals by city officials who granted a general plan amendment to expand the allowance for the development from 20,000 square feet to nearly 60,000 square feet.<\/p>\n<p>Along with using the space of three holes, the parcel also hosts a driving range, pro shop and restaurant, which would be removed.<\/p>\n<p>Following the approval of the needed general plan amendment for the additional square footage requested by the surf park plan, opponents gathered the needed signatures on a petition to force a ballot initiative that would require a public vote on the amendment.<\/p>\n<p>The City Council in late January decided instead of the public vote it would just rescind its approval for the general plan amendment that allowed for the larger-scale plan to proceed.<\/p>\n<p>But because it is private property, a smaller surf park with a 20,000-square-foot footprint could still be possible, city staff have said.<\/p>\n<p>Now, golf enthusiasts have filed the lawsuit against the city, hoping to squash any plans to build a wave pool of any size on the golf course.<\/p>\n<p>The lawsuit argues that rescinding the general plan amendment should have also made a surf park on the site invalid.<\/p>\n<p>The opponents argue that any surf park, at any scale, would require a new general plan amendment, new entitlement proceedings and new environmental review.<\/p>\n<p>\u201cThis case is about preserving the efforts of the Newport Beach constituents who successfully stood up to an attempt to unlawfully deprive their community of a beloved public golf course,\u201d the lawsuit says.<\/p>\n<p>The course is the only in Newport Beach that is public and has accessible prices, the complaint contends. An 18-hole weekday round costs about $34, far less than private courses, making it a place that draws retirees and veterans, as well as kids and young adults.<\/p>\n<p>\u201cGenerations have learned to love and appreciate the game of golf there,\u201d the lawsuit says.<\/p>\n<p>The city\u2019s position is that both the referendum petition and the City Council\u2019s response were narrowly focused. The referendum only contested the general plan amendment and the City Council only rescinded that specific amendment, removing the approved expansion of the development and keeping the original 20,000-square-foot limit intact, according to a statement from the city.<\/p>\n<p>Other approvals were outside the scope of the referendum and were not revoked, the city argues.<\/p>\n<p>\u201cReducing the square footage simply adjusts the project\u2019s overall scale and does not alter the approved use\u2019s fundamental nature,\u201d city officials said. \u201cThe approvals define the permitted use, site layout and operations.
