Jared Polis reduced Tina Peters\u2019 sentence by half on Friday, appearing to bend to demands from President Donald Trump \u2014 while ignoring the pleas of many other Colorado elected officials and the prosecutor who won\u00a0the former county clerk\u2019s conviction in an election data-breach scheme.<\/p>\n<p>Read more <a href=\"https:\/\/siliconvalleymovingpost.com\/?p=6797\">Tennessee man known for racist videos held on $1.25M bond for courthouse shooting<\/a><\/p>\n<p>In a letter to Peters, Polis wrote that she will \u201cbe released on parole effective June 1, 2026\u201d \u2014 in just over two weeks.<\/p>\n<p>The commutation, which was announced in a group of 44 clemency actions Friday afternoon, reduced Peters\u2019 original sentence of nearly nine years,\u00a0which was thrown out last month, to about 4.5 years.<\/p>\n<p>Peters, the former Mesa County clerk, has been a public supporter of election conspiracies rooted in Trump\u2019s reelection loss in 2020. Polis told The Denver Post in an interview Friday, ahead of the commutation announcements, that \u201cjust because somebody believes the Earth is flat \u2014 just because somebody believes in conspiracy theories \u2014 does not mean that they should receive a harsher sentence for a very specific crime.\u201d<\/p>\n<p>Polis\u2019 action drew swift reaction from other elected Democrats.\u00a0In an interview, Secretary of State Jena Griswold called Polis\u2019 decision \u201can affront to democracy\u201d and accused the governor of \u201cselling out our state justice system to cave to a vengeful president.\u201d<\/p>\n<p>Griswold, the state\u2019s top elections official, said she\u2019d had one conversation with Polis about his decision \u2014 and it occurred at 2 p.m. Friday, less than an hour before the news broke.<\/p>\n<p>\u201cIt tells a lawless president that if he pushes hard enough, he\u2019ll get his way,\u201d she said. \u201cAnd that is dangerous for the rule of law.\u201d<\/p>\n<p>Trump quickly\u00a0posted a short reaction\u00a0on his platform Truth Social: \u201cFREE TINA!\u201d<\/p>\n<div>\n<\/div>\n<p>Last month, the Colorado Court of Appeals\u00a0reversed Peters\u2019 eight-year prison term, which was part of an overall nine-year sentence, and ordered a Mesa County judge to resentence her. But that hasn\u2019t yet happened, and Peters\u2019 attorneys also still have time to further appeal her convictions.<\/p>\n<p>Peters, 70, has been serving her sentence since October 2024. Her attorneys did not immediately respond to a request for comment Friday.<\/p>\n<p>On Friday, Polis quoted from the appeals court\u2019s decision, which said Peters\u2019 original sentence was wrongly based on her exercise of protected free speech, to defend his clemency decision. She will remain a felon under the commutation, and Polis argued that her sentence would remain harsher than what her co-defendants received \u2014 just not unduly harsh.<\/p>\n<p>While Peters has not publicly shown contrition for her crimes, Polis said she did so in her clemency application. His office previously denied a public records request for that application.<\/p>\n<div>\n<\/div>\n<p>\u201cIt\u2019s important to get past our emotions, which I share, about election conspiracy theories,\u201d Polis said. \u201cI condemn them. I condemn any acts of threats or violence against our incredibly talented election workers on both sides of the aisle.<\/p>\n<p>\u201cAnd it\u2019s important to look at, as we do in any case, the facts of the case \u2014 and make sure that we live in a society that upholds the value of freedom of speech, and that even when somebody holds incorrect and unpopular opinions, that speech is not held against them in a sentencing.\u201d<\/p>\n<p>Polis\u2019 decision comes two days after the annual legislative session adjourned \u2014 meaning that the governor appeared to have timed the commutation for when Democratic lawmakers, who\u00a0had blasted him for even considering intervening, could no longer take any action to formally condemn him. Polis is term-limited, so lawmakers will not convene for another regular session until after he has left office.<\/p>\n<p>Lawmakers sent the governor a letter in March, urging him not to release Peters early, and some had discussed holding a formal vote to censure him if he went ahead with commuting or pardoning the former clerk. Some lawmakers were told Friday morning that Polis planned to make an announcement about Peters\u2019 sentence later in the day.<\/p>\n<p>The commutation was also apparently not communicated well in advance to various outside officials.<\/p>\n<p>Dan Rubinstein, the Mesa County district attorney who prosecuted Peters, told The Post on Thursday that he had not received any new information about Polis potentially altering Peters\u2019 sentence, and he was still had not received word by early afternoon Friday. Matt Crane, who leads the Colorado County Clerks Association, said he was also unaware of any plans.<\/p>\n<p>As of late Friday morning, Griswold\u2019s office and Attorney General Phil Weiser\u2019s office said they still had not received any word from the governor\u2019s office on the matter.<\/p>\n<p>Polis\u2019 decision did not only ignore the pleas of the legislature\u2019s majority Democrats. His announcement also bucked\u00a0repeated requests from a slew of elected officials\u00a0\u2014 including Griswold, Weiser, Rubinstein and a coalition of county clerks \u2014 who had publicly implored him not to interfere.<\/p>\n<p>Read more <a href=\"https:\/\/siliconvalleymovingpost.com\/?p=6793\">Man arrested after allegedly trespassing on Chris Brown\u2019s Tarzana estate 3 times in 3 days<\/a><\/p>\n<p>Polis said that \u201cmy judgment is not based on what I hear from other people,\u201d whether it was from people who wanted Peters\u2019 sentence upheld, lessened or wiped away. That included the Republican president, who\u00a0has claimed to pardon Peters\u00a0\u2014 a power he does not have for state-level convictions \u2014 and who said on New Year\u2019s Eve that he hoped Polis and others would \u201crot in hell\u201d for Peters\u2019 sentence.<\/p>\n<p>Around that same time, Polis\u2019 office sought input on Peters\u2019 clemency application from District Court Judge Matthew Barrett, who sentenced Peters. In a Jan. 13 letter to the governor obtained by The Post, Barrett wrote that Polis\u2019 chief legal counsel had spoken with him about the application,\u00a0as required under Colorado law. Barrett wrote that he had \u201ccarefully considered\u201d Peters\u2019 personal circumstances before sentencing her, as well as \u201cher lack of accountability.\u201d<\/p>\n<p>\u201cI chose a sentence in roughly the midpoint of the presumptive ranges that this state\u2019s General Assembly has set,\u201d the judge wrote.<\/p>\n<p>He told the governor that he would respect whatever decision Polis made and that he trusted any decision would be made \u201cfor the right reasons.\u201d<\/p>\n<p>\u201cI\u2019m hopeful that my decision today will restore the confidence that the people of Colorado have that, regardless of their political opinions or beliefs, they will receive equal justice under the law,\u201d Polis said Friday.<\/p>\n<p>He announced Peters\u2019 commutation as part of a slate of clemency decisions Friday.\u00a0In addition to Peters, Polis announced he will commute the sentences of eight other inmates, including people who had been sentenced to life in prison without parole for murder charges, and that he would pardon 35 others.<\/p>\n<p>Polis has typically announced commutations and pardons around the holidays at the end of each year, which\u00a0he did not do in December\u00a0amid renewed pressure from the Trump administration.<\/p>\n<p>He says he is still reviewing other clemency applications and plans to announce others before he leaves office in January.<\/p>\n<p>Despite the intense public and private pressure and months of open consideration for granting Peters clemency, Polis said other commutations, particularly those in cases involving the loss of life, were much harder decisions.<\/p>\n<p>A jury found Peters guilty in August 2024 of providing a person outside the clerk\u2019s office \u2014 who was affiliated with noted election-denier Mike Lindell \u2014 with access to Mesa County\u2019s voting systems after the 2020 election, as part of Trump\u2019s baseless claims of election fraud.<\/p>\n<p>In the 19 months\u00a0since she was sentenced, neither Peters nor her legal team has shown any contrition publicly for the conduct that led to her felony convictions. Indeed, just last week, her supporters\u00a0published an apparent letter she\u2019d written to Trump, in which she calls herself a political prisoner and repeats election conspiracy theories.<\/p>\n<p>The former clerk was convicted of three counts of attempting to influence a public servant, one count of conspiracy to commit criminal impersonation, first-degree official misconduct, violation of duty and failing to comply with the secretary of state.<\/p>\n<p>Peters received at least four negative write-ups during her first year in prison. In January, surveillance footage showed Peters\u00a0grabbing and shoving a fellow inmate\u00a0during a brief scuffle in a prison common area. Peters was later\u00a0found not guilty of assault\u00a0but was found guilty of a lesser charge.<\/p>\n<p>As he has faced pressure from the president, Polis has said he would not release Peters as part of any sort of deal with the Trump administration. Other officials, including U.S. Sen. Michael Bennet, have accused Trump of retaliating against the state for its refusal to release Peters.<\/p>\n<p>Since last fall, federal officials announced the dismantling of\u00a0Boulder\u2019s National Center for Atmospheric Research, while Trump vetoed\u00a0a bipartisan bill to help pay for a water pipeline\u00a0in southeastern Colorado, and his administration halted and stripped federal funding for state programs.<\/p>\n<p>Federal officials have also\u00a0threatened to undercut the state\u2019s wolf reintroduction program, hampering an effort that\u2019s been embraced by Polis\u2019 husband, Marlon Reis.<\/p>\n<p>It was unclear if Polis\u2019 commutation decision would ease or reverse any of those moves.
