Robinson said Ebony Parker\u2019s actions do not amount to a crime under Virginia law.<\/p>\n<p>Parker leaned over at the defense table and broke down in tears after learning the charges against her had been dismissed.<\/p>\n<p>The former assistant principal was charged in the January 2023 shooting at Richneck Elementary School in Newport News that left teacher Abby Zwerner wounded. Prosecutors had said the charges were for each of the bullets in the gun brought into\u00a0Zwerner\u00a0\u2019s classroom. Each count could have carried a maximum penalty of five years in prison upon conviction.<\/p>\n<p>Robinson granted the motion after\u00a0three days of the prosecution\u2019s case\u00a0\u2014 before the defense had put on any evidence.<\/p>\n<p>A judge granting a motion to strike at this phase of a jury trial happens only rarely. But Robinson said she made her decision after listening to the evidence the past several days.<\/p>\n<p>\u201cIt\u2019s by the grace of God,\u201d said Parker\u2019s mother, from the Chesterfield area, said as she walked from the courthouse after Robinson\u2019s ruling.<\/p>\n<p>Read more <a href=\"https:\/\/siliconvalleymovingpost.com\/?p=8458\">Process over results carries Cal State Fullerton women\u2019s golf to postseason<\/a><\/p>\n<p>\u201cIt\u2019s been a long, long haul, for not a good reason,\u201d she said as her eyes welled with tears.<\/p>\n<div>\n<\/div>\n<p>\u201cShe\u2019s a really great educator. A great teacher. A great person to advocate for the kids. That\u2019s what breaks my heart, because these kids need every help they can get.\u201d<\/p>\n<p>One of Parker\u2019s lawyers, Curtis Rogers, said that while she might have \u201cmade a mistake\u201d and had a \u201clapse in judgement\u201d on Jan. 6, 2023, she did not commit a crime.
