So what is a short-term rental? A short-term rental could be Uncle Joe’s house that you inherited but remains unoccupied, except for that rare visit by out-of-town relatives.
A short-term rental could utilize that empty house and increase your bottom line, but there are rules.
First, there is a $1,000 license application fee. You must have the Brea business license. They are taking applications now to operate a short-term rental property and follow certain rules.
The main rule is that a short-term rental means the renters can only occupy the unit for no more than 30 consecutive nights.
The owner must be at least 25 years old and legally responsible for any complaints involving the unit’s occupants and their guests. And prospective renters must also be 25 or older to rent the unit.
The unit cannot be sublet by the renter or used for commercial purposes, weddings, receptions, big parties or sales events.
The unit can be a single-family house, a multi-family rental property, including a condominium, a duplex or a triplex that you own, not rent.
“Applicants that lease property or sub-lease property, like residents who rent from Avalon Apartments, would not be eligible for a Short Term Rental License,” said Jason Killebrew, Brea’s assistant city manager/community development director.
The rentals also cannot be ADUs, or Accessory Dwelling Units, junior ADUs, recreational vehicles, hotels, motels, timeshares, bed and breakfast inns or affordable housing. Only one STR is issued per property, except for condos, townhomes and apartments. Forget about applying for a license if you are a property owner who has a record of operating unauthorized STRs.

It gets better. Only 100 applications will be accepted in the pilot program, and your dwelling unit must pass a home inspection to be issued a STR license.
The 100 will be divided into three sectors of the city. East Sector, east of the 57 Freeway to Sleepy Hollow, gets 25 licenses. Northwest Sector, west of the 57 Freeway, north of Lambert Road gets 25 licenses. But the Southwest Sector, west of the 57 Freeway, south of Lambert Road to the Fullerton border gets 50 licenses.
Killebrew also noted that the annual license fee is $1,000. As a short-term rental operator, you will be required to collect Transient Occupancy Taxes and remit them to the City. If you are ready to bring life back into Uncle Joe’s house, now might be the time.
This is also the time for many May events in Brea.
